Welcome to Tixbro! These Terms and Conditions ("Terms") govern your use of the Tixbro website, mobile application, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Platform.

1. Definitions

  • "Tixbro," "we," "us," or "our" refers to the Tixbro platform and its operators.
  • "User," "you," or "your" refers to any person accessing or using the Platform.
  • "Event Organizer" refers to individuals or entities listing events on the Platform.
  • "Ticket" refers to any booking, reservation, or entry pass purchased through the Platform.
  • "Event" refers to any concert, sports match, theatre show, turf booking, college fest, or other activity listed on the Platform.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years old to create an account and make purchases on Tixbro. By using the Platform, you represent and warrant that you meet this age requirement.

2.2 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • You are solely responsible for all activities that occur under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

2.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3. Ticket Booking and Purchases

3.1 Booking Process

  • All ticket purchases are subject to availability.
  • Prices displayed on the Platform are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
  • A booking is confirmed only when you receive a confirmation email and/or SMS with your ticket details.

3.2 Payment

  • We accept various payment methods including credit cards, debit cards, UPI, net banking, and digital wallets.
  • All payments are processed securely through our payment gateway partners.
  • You authorize us to charge the payment method provided for all fees and applicable taxes.

3.3 Service Fees

Tixbro charges a service fee for facilitating ticket bookings. This fee covers platform maintenance, customer support, and transaction processing. Service fees are clearly displayed before you complete your purchase and are non-refundable except as required by law.

3.4 Ticket Limits

Event organizers may impose limits on the number of tickets you can purchase per transaction or per event to prevent scalping and ensure fair access.

4. Event Organizer Responsibilities

4.1 Listing Events

Event organizers must:

  • Provide accurate event information including date, time, venue, and pricing.
  • Have all necessary permits, licenses, and insurance for their events.
  • Honor all tickets sold through the Platform.
  • Comply with all applicable laws and regulations.

4.2 Event Changes or Cancellations

  • If an event is cancelled, postponed, or significantly modified, the event organizer must notify Tixbro immediately.
  • Refunds for cancelled events are the responsibility of the event organizer as per our Refund Policy.
  • Tixbro reserves the right to issue refunds on behalf of organizers if they fail to do so within a reasonable timeframe.

5. User Conduct

You agree NOT to:

  • Use the Platform for any illegal or unauthorized purpose.
  • Violate any laws in your jurisdiction (including but not limited to copyright laws).
  • Resell tickets at prices higher than face value (ticket scalping).
  • Use automated systems or software to extract data from the Platform (scraping).
  • Interfere with or disrupt the Platform or servers/networks connected to the Platform.
  • Create multiple accounts to circumvent ticket limits.
  • Post false, inaccurate, misleading, or defamatory content.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. Ticket Usage and Entry

6.1 Ticket Validity

  • Tickets are valid only for the specific event, date, time, and venue indicated.
  • Entry to events is at the sole discretion of the event organizer and venue.
  • You may be required to present valid photo identification matching the name on the ticket.

6.2 Mobile Tickets

  • E-tickets and mobile tickets must be presented on a device with sufficient battery and screen brightness.
  • Screenshots of tickets may not be accepted; original digital tickets from the Tixbro app/email are required.
  • Each ticket contains a unique QR code that can only be scanned once.

6.3 Lost or Stolen Tickets

Tixbro is not responsible for lost, stolen, or damaged tickets. Please contact our customer support immediately if you believe your ticket has been compromised.

7. Intellectual Property Rights

7.1 Platform Content

All content on the Platform, including text, graphics, logos, images, videos, software, and data compilations, is the property of Tixbro or its content suppliers and is protected by Indian and international copyright laws.

7.2 Trademarks

Tixbro, the Tixbro logo, and other marks are trademarks of Tixbro. You may not use these trademarks without our prior written permission.

7.3 User-Generated Content

By posting reviews, comments, or other content on the Platform, you grant Tixbro a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content.

8. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using Tixbro, you consent to our collection and use of your data as described in the Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Platform "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Event Responsibility

Tixbro is a booking platform and is not the organizer or producer of events. We are not responsible for:

  • The quality, safety, legality, or suitability of events.
  • The accuracy of event information provided by organizers.
  • Injuries, damages, or losses occurring at events.
  • Event cancellations, postponements, or changes.

9.3 Limitation of Liability

To the maximum extent permitted by law, Tixbro and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:

  • Your use or inability to use the Platform.
  • Unauthorized access to or alteration of your data.
  • Statements or conduct of third parties on the Platform.
  • Any other matter relating to the Platform.

Our total liability shall not exceed the amount you paid for the specific ticket giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tixbro and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights.
  • Your User-Generated Content.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in [Your City], India.

11.3 Arbitration

Before filing any legal action, parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on the Platform with a new "Last Updated" date.
  • Sending an email notification to registered users (for significant changes).

Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

13. Termination

13.1 Termination by User

You may terminate your account at any time by contacting our customer support. Termination does not relieve you of obligations related to past bookings.

13.2 Termination by Tixbro

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms or applicable laws.
  • Could harm Tixbro, our users, or third parties.
  • Exposes us to legal liability.

14. Force Majeure

Tixbro shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Tixbro regarding the use of the Platform and supersede all prior agreements and understandings.
